Article 1 — Purpose

These Terms of Use (hereinafter "Terms") aim to define the terms and conditions of use of the PropertIA platform, accessible at https://propertia-app.com (hereinafter the "Platform"), published by PropertIA (hereinafter the "Publisher").

Use of the Platform implies full and complete acceptance of these Terms. Any user who does not wish to accept these conditions must cease all use of the Platform.

Article 2 — Definitions

  • "User": any natural or legal person registered on the Platform.
  • "Credits": virtual currency unit used to access the Platform's AI tools. Credits have no monetary value and are non-refundable.
  • "AI Tools": all artificial intelligence features offered on the Platform, including estimation, sales diagnostics, AI negotiator, listing generator, photo audit, and AI coach.
  • "Analysis": result produced by an AI Tool from data provided by the User.

Article 3 — Registration and account

Using the AI Tools requires creating a personal account. The User agrees to provide accurate, complete, and up-to-date information during registration. Any false declaration may result in account suspension.

The User is solely responsible for the confidentiality of their login credentials. Any activity carried out from their account is deemed to have been performed by the User. In case of unauthorized use, the User must immediately inform the Publisher at contact@propertia-app.com.

In accordance with Article 6 of French Law No. 2004-575 of June 21, 2004 on confidence in the digital economy, the Publisher retains User identification data.

Article 4 — Credits and pricing

Each AI Tool consumes a defined number of credits, clearly indicated before launching the analysis. The User receives 80 free credits upon registration and 10 free credits each day they log in, with no purchase requirement.

Credits are valid for life and never expire. They cannot be transferred to a third party, converted into cash, or refunded, in accordance with Article L. 112-1 of the French Monetary and Financial Code.

The Publisher reserves the right to modify credit pricing and tool costs, subject to 30 days' notice. Credits acquired before the modification retain their purchase value.

Article 5 — Nature of AI analyses

The analyses provided by the AI Tools are indicative and non-contractual. They constitute estimates and recommendations based on data provided by the User and the Publisher's artificial intelligence models.

The analysis results do not constitute legal advice, certified real estate expertise, official real estate estimation within the meaning of Article R. 321-17 of the French Construction and Housing Code, or investment advice. The User is strongly advised to consult a qualified professional (real estate agent, notary, lawyer, financial advisor) before making any important decision.

The Publisher cannot be held responsible for decisions made by the User based on the analyses provided by the Platform. The User acknowledges that AI results may contain inaccuracies and should be subject to thorough verification.

Article 6 — Lead matching (AI Matching)

The Platform offers a lead matching service between individuals and real estate professionals. When using an AI Tool, the individual User may accept being contacted by up to 3 certified real estate professionals, in exchange for 80 free credits.

The User gives their express and informed consent before any matching, in accordance with Articles 6 and 7 of the General Data Protection Regulation (GDPR). This consent may be withdrawn at any time via account settings.

The Publisher does not guarantee the quality of exchanges between Users and professionals, nor the completion of a real estate transaction. Professionals are responsible for their own commercial activities.

Article 7 — Intellectual property

All elements composing the Platform (texts, images, logos, trademarks, software, AI models) are the exclusive property of the Publisher or its partners and are protected by French and international laws relating to intellectual property, notably the French Intellectual Property Code.

Any reproduction, representation, modification, distribution, or exploitation, even partial, of all or part of the Platform's elements, by any means whatsoever, without the Publisher's prior written authorization, is strictly prohibited and constitutes infringement sanctioned by Articles L. 335-2 et seq. of the Intellectual Property Code.

Article 8 — Liability

The Publisher provides the Platform "as is" and does not guarantee continuous and uninterrupted availability of services. The Publisher reserves the right to interrupt access to the Platform for maintenance, security, or force majeure reasons, without notice or compensation.

In accordance with Article 1231-3 of the French Civil Code, the Publisher cannot be held liable for indirect damages, foreseeable or unforeseeable, resulting from the use of the Platform, including data loss, financial losses, or missed opportunities.

The Publisher's total liability towards a User, for all claims combined, is capped at the amount of credits purchased by the User in the last 12 months.

Article 9 — Personal data

The processing of Users' personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016 (GDPR) and French Law No. 78-17 of January 6, 1978 on data processing, data files, and individual liberties.

Article 10 — Governing law and jurisdiction

These Terms are governed by French law. In case of dispute relating to the interpretation or execution of these Terms, the parties shall endeavor to find an amicable solution. Failing that, the dispute shall be submitted to the competent courts of Paris, in accordance with Article 42 of the French Code of Civil Procedure.

In accordance with Regulation (EU) No. 524/2013, Users residing in the European Union may use the online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr

Article 11 — Modification of Terms

The Publisher reserves the right to modify these Terms at any time. Users will be informed of any substantial modification by notification on the Platform or by email. Continued use of the Platform after modification constitutes acceptance of the new conditions. If the User refuses, they must cease using the Platform and may request account deletion.
