Terms of Sale

Article 1 — Purpose

These Terms of Sale (hereinafter "Terms") aim to define the terms and conditions of sale for credits and subscriptions offered on the PropertIA platform, accessible at https://propertia-app.com (hereinafter the "Platform"), published by PropertIA (hereinafter the "Publisher").

The purchase of credits or subscription to a plan implies full and complete acceptance of these Terms, in accordance with Article 1127 of the French Civil Code.

Article 2 — Products and pricing

PropertIA offers for sale virtual credits allowing access to the Platform's AI Tools, as well as monthly subscriptions including a defined number of credits. Credits are virtual currency units used exclusively on the Platform to access artificial intelligence tools.

Prices are displayed in euros including all taxes (TTC) on the Platform. The Publisher reserves the right to modify prices at any time, subject to 30 days' notice in accordance with Article L. 441-3 of the French Commercial Code. Credits acquired before the modification retain their purchase value.

In accordance with Article L. 113-3 of the French Consumer Code, prices, any discounts, and payment methods are clearly indicated before any order.

Article 3 — Order and payment

The User can purchase credits or subscribe to a plan directly on the Platform via the integrated payment system. The order is confirmed upon receipt of full payment. A receipt is sent by email to the address provided during registration.

Payment is made by credit card (Visa, Mastercard, American Express) or by any other payment method offered on the Platform. Transactions are secured in accordance with industry standards (SSL/TLS encryption).

In accordance with Article L. 441-6 of the French Commercial Code, payment terms are specified before order validation. Credits are credited to the User's account immediately after payment confirmation.

Article 4 — Nature of credits

Purchased credits are valid for life and never expire. They cannot be transferred to a third party, converted into cash, or refunded, in accordance with Article L. 112-1 of the French Monetary and Financial Code. Credits are exclusively usable on the PropertIA Platform to access AI Tools.

Each AI Tool consumes a defined number of credits, clearly indicated before launching the analysis. The User is informed of the credit cost before each use and must expressly confirm their consent before the analysis is launched.

Article 5 — Subscriptions

Subscriptions are tacitly renewed on a monthly basis. The User may cancel their subscription at any time from their account settings on the Platform, without cancellation fees. Cancellation takes effect at the end of the current period, and the User retains access to their credits and features until that date.

In accordance with Article L. 215-1 of the French Consumer Code, the Publisher reminds the User, at least one month before the expiry date, of the possibility not to renew the subscription. If not cancelled, the subscription is automatically renewed for a period equal to the initial period.

Article 6 — Right of withdrawal

In accordance with Article L. 221-18 of the French Consumer Code, the User has a period of 14 days from the date of purchase to exercise their right of withdrawal, without having to provide a reason or pay a penalty.

However, in accordance with Article L. 221-28 of the French Consumer Code, the User loses their right of withdrawal if they have expressly requested the execution of the service before the end of the withdrawal period and thereby acknowledges waiving it. Once the User uses the purchased credits, they acknowledge having expressly requested the execution of the service and waive their right of withdrawal.

To exercise the right of withdrawal, the User must send their request to: contact@propertia-app.com, specifying their identity and the order reference.

Article 7 — Refund

Unused credits may be refunded within 14 days of purchase, in accordance with the right of withdrawal mentioned in Article 6. Beyond this period, credits are non-refundable, in accordance with Article L. 112-1 of the French Monetary and Financial Code.

In the event of a proven technical malfunction preventing the use of credits for more than 48 consecutive hours, the Publisher will proceed with a proportional refund based on the number of unusable credits or an extension of the subscription period, at the User's choice.

Article 8 — Warranties

In accordance with Articles L. 217-4 et seq. of the French Consumer Code, the Publisher guarantees the conformity of the services provided. The analyses generated by the AI Tools are indicative and non-contractual, as specified in the Terms of Use.

The Publisher guarantees that the Platform operates in accordance with its description and that purchased credits are properly credited to the User's account. In case of non-conformity, the Publisher undertakes to remedy the problem as soon as possible or to refund the affected credits.

Article 9 — Disputes and mediation

In case of dispute relating to the interpretation or execution of these Terms, the User is invited to first contact the Publisher at contact@propertia-app.com to seek an amicable solution.

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, the User may use a consumer mediator free of charge for the amicable resolution of the dispute. The competent mediator will be communicated upon request.

Article 10 — Personal data

The processing of personal data related to financial transactions is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of January 6, 1978. Billing data is retained for 10 years in accordance with Articles L. 123-22 and L. 123-23 of the French Commercial Code.

Article 11 — Governing law and jurisdiction

These Terms are governed by French law. In case of dispute, the competent courts of Paris shall have sole jurisdiction, in accordance with Article 42 of the French Code of Civil Procedure. For Users who are consumers within the meaning of Article L. 611-1 of the French Consumer Code, the competent court is determined in accordance with common law rules.

Article 12 — Modification of Terms

The Publisher reserves the right to modify these Terms at any time. Users will be informed of any substantial modification by notification on the Platform or by email, with 30 days' notice. Credits acquired before the modification retain their purchase value. Continued use of the Platform after modification constitutes acceptance of the new conditions.
